How long are we able to stay in our home after bankruptcy has been claimed, or do we need to vacate prior to claiming?

Most trustees will strongly suggest you move out BEFORE you actually file if you plan on surrendering the house to your mortgage company. By moving out before you file it makes it perfectly clear to everyone involved that you are gving up the house. If you stay in the house after you file you will be expected to continue to make utility andf mortgage payments while you remain in the house.
