If I was to file bankruptcy within the next week when would the bankruptcy occur? in 2010 when I sign or in 2011 when the superintendent of bankruptcy receives it?

A licensed trustee said...

The vast majority of bankruptcy assignments are now processed electronicly – that means the day you sign should be the date the documents are sent to the Superintendent. Ask the trustee that you are dealing with how quickly they intend to process your file – in our firm the documents are uploaded immediately upon signing.
