Yes, as soon as you are in a position where you are unable to meet the standard terms on the original financing contract then your creditor has the legal right to take you to court. The collection agency is not obligated to accept payment arrangements if they do not meet the minimum terms of that contract and they can take you to court for collection at any point in time.
