407ETR & Bankruptcy

When I filed in 2006 I had an old account included for the 407ETR which dated back to 2002. Now after all these years I received a notice saying there was a balance that has ballooned to $5000 +. I just called them and advised them about the Bankrupcty and was told that as of 2005 they no longer accept Bankruptcy`s? HELP!

You have stumbled onto a very unpleasant aspect of bankruptcy law. A few years ago the Court made a ruling that the 407’s lawyers have decided to use to say theur debts are excluded from bankruptcy. I think they are wrong, but until someone applies to the Court to make a new ruling they are going to continue to ignore bankruptcies.

Before you ask, a trustee cannt briong this motion – we’ve asked the Court about it and were told that a bankrupt person needs to do so…

So, if you want to help everyone out, hire a lawyer and apply to the Court to havew rule on what the 407 is doing… Sorry, but until someone does this they will keep trying to collect their fees.
