I owe President`s Choice Mastercard about $5000. I own a house with my husband and my son (mortgage). Collector kept calling me and leave messages on my answer machine stating that she is doing paper work to have someone to come out to see my property. I am currently disable and have no source of income. Could you kindly let me know if creditor/collector allow to come to my house without any court order? Are they just threating me?

I’ve never heard of a collection agent actually doing this – so it is very likely a hollow threat, BUT there is no law stopping them from driving over to have a look at your house. Obviously they can’t go in unless you invite them in or they have a Court order.

While you have no income there is not much a creditor can do to you unless there is equity in your home. If there is and the creditor sues you (takes you to Court) they will likely get a Writ of Seizure and Execution which will allow them to register the debt with the sheriff. If the hosue is sold the debt will be repaid from the proceeds of the sale.
