Car Lease
Hi, I`m planning on filing bankruptcy within the next few months. Im just getting everything together. I returned my leased car to the dealership. They are saying they will bring me to court for payment even tho they are aware of my situation. They also state that any free for court I will have to pay. IF it does indeed go to court will I still beable to file bankruptcy on the lease loan?

Until you file for bankruptcy they dealership is legally able to take you to court for payment of any arrears and they are correct in that you can technically be held responsible for the court costs. However, if you file for bankruptcy, the court activity will stop, this loan and the associated legal costs will be considered an unsecured debt that is released by the filing of a bankruptcy.
