If I declare bankruptcy and I have a house with some equity in it, and the house is in my spouse and my name. How this will affect my house and my spouse in terms of the house.

If you have a house and it is in your spouse’s name, as long as it has always been in your spouses name the filing of a bankruptcy likely won’t have any impact on the property.

However, this is a very important issue to discuss in detail with a local trustee as the specifics of your situaiton will have a significant bearing on whether or not this will hold true.
