I am not quite sure what you are referring to.
However, if you are referring to the Superintendent’s surplus income obligation that is used to determine cost and length of a bankruptcy, this doesn’t involved house and car payments. Essentially what it does is it stipulates how much you are allowed to bring into the household given the number of dependents that you support and then determines a) if you qualify for the minimum cost; and b) if you do not qualify for the minimum cost then how much your monthly cost of bankruptcy will be. For example, if you are a single person you are able to make up to $1870 after tax each month to qualify for the minimum cost of a bankruptcy.
If you are referring to the eligibility requirements of a bankruptcy, they also are irrespective of house and car payments. Ultimately as long as you owe greater than $1000 and cannot afford to pay your debts as they become due then you technically would qualify to file.
