I will be filing for bankruptcy soon. I am wondering if my 2 children both full time university students ages 22 and 18 will be considered my dependents for surplus income calculation or not?

When filing for bankruptcy your family unit includes, in addition to yourself, any persons who reside in the same household and who benefit from either the expenses incurred or income earned by you or who contribute to such expenses or earnings.

However, if your children are not living with you then they can only be considered as a member of the family unit if the person benefits from, or participates in, the households income or expenses.
