I am in bankruptcy ast of fall 2008 . I make very little income during winter months so I have paid little or no surplus payments. During the summer months , my income is higher and save it to live throughout the lean months . However , if I make surplus income payments based on my high income months , I would be left with little or no savings for these lean months . Am I overlooking an option here. ? Thank You

I don’t think you are overlooking anything. The one thing that may be helpful are the averaging provisions of the Superintendent’s surplus income calculation. They permit any higher months to be averaged with all the months during bankruptcy and may result in a smaller payment. You may want to discuss this with your trustee.
