I claimed bankruptcy in Feb.2009 what happens if I getting a refund on my income tax and have already spent it not knowing it was part of the bankruptcy

You will have to discuss this with your trustee. Likely you will have to repay this amount as it did not belong to you. Failure to disclose this to your trustee would be considered an offense under the Bankruptcy & Insolvency Act and could cause you fairly serious difficulties.
