Yes you would qualify to file for bankruptcy. The only difficulty you will run into is that there is a cost to bankruptcy. This cost is largely tied to income so if you are on EI and have marginal income you would likely be looking at what we refer to as a minimum cost bankruptcy. I would recommend that you contact a local trustee to see what the local cost is in your area and to make arrangements to discuss how a bankruptcy will unfold given your situation.
