Sleepless in St. Catharines
Hi,
It`s been 10 years since I graduated (October -1999). I have been unemployed for 5yrs and on disability (ODSP) for about three years now. I also have three disabled children. My point is I am unable to pay back my student loans and have not been financially able since graduating due to the fact my employment field only hired part time in that decade (nursing). Other than the student loan I have very little debt. Am I able to file for bankruptcy, and what is the likelihood of the loans being included and dealth with, or do I need to wait until after October of this year? I would love a `clean slate`.
Thanks,

As of July 2008, you only need to have been out of school for 7 years in order to have student debts dischargeable in a bankruptcy. based on your note, it sounds like you meet that criteria so there should not be any issues.
