my name is on the the tittle with my comon-law husband to our house and it still has a high mortgage on it. I am finacilly strapped and am thinking of applying for personal bankrupcy. can i still apply with out the house being touched.

This is going to depend on how much equity is in the property and where you live. If you are in the greater vancouver area or Victoria then you are allowed to have up to $12,000 equity in the property. In the rest of BC you are allowed to have up to $9,000. If the equity is higher than the allowable amount, then filing bankruptcy may have an impact on the house. The best thing to do is to contact a local trustee, bring in the details about your house (i.e value, amount of mortgage etc.) and they will be able to explain exactly what would take place.
