I owe employment insurance 16000.00 would that be included in a bakruptcy. It was due to a judgement that recieved reg ei payments while I was ill. I recieved the wrong benefit

Yes an EI overpayment will be cleared by a bankruptcy. One thing to note is that in the last couple of years the government tried to claim this was a benefit that was fraudulent received and argued that it would survive bankruptcy. The problem is they made that decision they didn’t use the courts and the courts are the only body that has the right to make that decision. So just be warned, if the government try’s something like this, they don’t have the authority to determine whether a debt is fraudulent or not, if they don’t go to court and if the court doesn’t rule it is fraudulent then it isn’t fraudulent.

As this can be a confusing issue you are best to discuss it in person with a local trustee.
