Applying for Discharge under 5 year Hardship Rule
Hi,
I am a mom of soon to be 4 (due in a few weeks). I am not working or receiving EI, my spouse makes barely enough to cover our expenses. I claimed bankruptcy in 2005, and have since been discharged. I convocated over 6 years ago, never to find a decent job in my field. I have exhausted Interest Relief, and was turned down for Debt Reduction in Repayment. I have yet to make a payment on my loans, as I simply do not have the funds. My question is, is it possible to have my loans discharged under the 5 year hardship rule? If so, how do I go about this? Also, does this cover all of my loans (from the Gov`t and bank), or just the Canada loan?

Contact the trustee that handled your bankruptcy – in the next week or so the governmetn has promised to publish the rules and regulations for the new student loan provisions.
