Bankruptcy and Child Support and Court Ordered judgements
My ex has claimed bankruptcy. He owes back support dated back to August of 2006. I know that declaring bankruptcy won`t resolve him of those arrears, but could his trustee be able to stop Family Response from enforcing the court order until he is discharged? Also, he claimed bankruptcy in February, in April I was awarded $5300 in court costs to be paid by him. Will his bankruptcy resolve him of that court order? Can a bankruptcy resolve someone of court ordered costs being paid? Thanks.

During a bankruptcy all of the creditors are prevented from continuing collection efforts except for those efforts related to alimony, spousal or child support. So Family response should still be in a position to enforce these outstanding arrears.
However, the $5300 is a different issue. As it is an award of court and not considered alimony, child support or spousal support it is cleared by the filing of a bankruptcy, regardless of whether it was ordered by court or not.
