Does surplus income affect the length of discharge
Hello,
I have read in some of these posts that surplus income effects the length of discharge in some cases.
When I file I will be making between 2300-2500 a month, which would be 460-660 over the $1836 limit.
I have spoken to a Insolvency Administrator and she told me that I will have to pay them $215 per month for the bankruptcy costs, but my surplus income would not effect my 9 month discharge.
Is this correct?

No, they are not. If you want to read the technical details look up Directive 11r from the Superintenent of Bankruptcy. This document sets out the rules for dealing with surplus income. If yiou have high surplus income payments your bankruptcy may be extended by up to 12 additional months.
