auto accident during bankruptcy

my truck was in an accident (the other guys fault) And his insurance company is writing my truck off. the Licensed Insolvency Trustee valued my truck at $5000 but the insurance co wants to write me a cheque for $14000 to replace it. do i get to replace it or do i have to give up the money? will the trustee find out if i dont tell him? the bill of sale is also in my ex-husbands name -could i get them to write him the cheque?

You need to be very careful as what you are proposing is fraud. Regardless of the circumstances fraud is illegal and if caught the ramifications will be severe.

What you need to do is to contact your trustee immediately and explain the situation. Failure to do so will definately put you at risk and at the very least will result in you not being eligible to be discharged from your debts..
