What if someone is garnishing my wages from a court order. Will my bankruptcy stop the garnishee?

Most wage garnishees are stopped when you file bankruptcy or a proposal, BUT there are a few exceptions…

We can’t stop:

– Child or spousal support payments
– Court Ordered restitution payments
– Payments for any other debt that is not dischargeable by bankruptcy.

You should take the Court Order with you when you go and speak to a trustee so that they may read it and then advise you on whether or not the garnishee will be stopped when you file.
