My ex-husband signed an agreement to take over a mortgage in 1991. I did not sign anything I was on holidays when he did this. He kept the house for two years, we were separated but not legally. He finally walked away from the dump and declared bankruptcy in 1995, we were back together then. Anyway the collection agency’s have been hounding me every 5 years or so for the debt still owing. I was told that even though I never signed anything the sheer fact that I was married to him makes my liable for the debt. Is this true? and if he declared bankruptcy when we were married doesn’t that include me as well?

In Canada you are only responsile for debts you have signed on. So if you never signed on the mortgage then you are not responsible for it.

However this also holds true with bankruptcy. The only way declaring bankruptcy will clear you from debt is if you signed on it. IF you didn’t sign the bankruptcy documents your spouses bankruptcy would have no impact on your debts.
