Collector certified my checks AFTER accepting payment arrangements

I freely admit that I owe money. Unfortunately illness and medical leave have caused this debt to be un-paid on time. However, some payment HAS been made, and the company agreed to allow me to continue doing so. Last week, they certified my checks, and drained my bank account, leaving me $31.00, no food, no rent, no hydro, etc. The checks came to more than what I owed due to the payment that was made (admittedly, not a lot more). Once they agree to arrangements – can they do this?

Legally what they have done is questionable. Practically, if you write a cheque to someone, they can cash it.

We recommend that you not write a series of post dated cheques to creditors. If you have, your only recourse may be to open a new bank account to protect your money. If you have other debts, we suggest you consult a trustee for further advice.
