oustanding debt while in bankruptcy
I recently filed for bankruptcy and did not include my coporate amex card in the bankruptcy. I owe money on it and can not pay it. My company does not cover the debt, I am responsible to pay. My discharge is not scheduled to happen until June 2006. Amex canceld the card recetnly and sent the debt to collection. Will this effect my ability to be discharged? Have I done something wrong by not including this debt in my bankruptcy? Also I am on maternity leave, what can the collection company do to me if I can not repay the debt at this time?

If the credit card is in your name you legally were required to list it in your bankruptcy and turn it over to your trustee. This may not be a material issue if you haven’t used the card since you filed bankruptcy, all you simply have to do is inform your trustee of the debt, have him send out the bankruptcy documentation and go from there. If you have used the card I recommend you contact your trustee to discuss the situation and see if there is anything that can be done. Be prepared to provide details as to the amount outstanding on the card prior to bankruptcy, any charges you have incurred since bankruptcy, and the total amount currently outstanding.
