Can wife claim bankruptcy without husband

I am living with my husband and want to claim bankruptcy but he doesn’t want to claim.
Can I do this on my own without him according to Ontario law?

There is no problem with you filing a bankruptcy on your own. The only issue that may cause problems is that if your husband signed jointly on any of the debts he will still be responsible these are paid in full.

I recommend discussing this with a licensed trustee in your area. They will be able to advise you further whether filing alone will be in your best interests.
