Discharged? Student Loans? Moving Forward?

This is a two parter….

I declared bankruptcy way back in November of 2001…submitted all my info monthly, provided all info on debtors, scraped together the money I could and received a conditional discharge in August of 2002. I was still making payments to my trustee, and that’s all that was required of me.

Unfortunately, I had a horrible two year span where I was unable to find money for food, let alone the trustee…and fast forward another two years and here I am…I last spoke with my Trustee in October of 2002 (because one of my student loan holders–I’ll get to that one in a minute–called me to find out when I’d be making payments since I was discharged from my bankruptcy)–the Trustee advised me to direct all inquiries to him, and that’s the last I’ve heard.

I’ve got a great job now and am finally making some decent money…I have no debts other than my student loans and I want to finally start rebuilding my credit so that I’m not living in a tiny little rented flat for the rest of my life…I’d love a house some day–or even a car (oh I dream of the day where I can complain about the price of gas).

So…I did what every responsible consumer should do and ordered my credit reports from the two agencies…all looks legit, a few errors in addresses and employment, but easily corrected–but it has no date to my bankruptcy discharge–says when it was declared, but not when it was discharged…surely I must be discharged by now?? What else do I need to do?

Second part…long winded, I know….who should I contact about my student loans? Both Federal and Provincial are held with collection agencies, and I do not want to deal with them on my own to negotiate payment!

From the sounds of things I am unsure whether or not you completed you obligations to your trustee (as listed in your conditional order(. If you did, you simply need to send a copy of your discharge certificate to the credit bureau and this should clear up this inconsistency. If you haven’t finished with the obligations to your trustee then there is a very good possibility you are still in bankruptcy. If that is the case you need to contact your original trustee and see what it will take to get things cleared up (be warned, if you have been left in bankruptcy there will be a cost to have your trustee reappointed and likely a penalty imposed by the courts once you have been discharged.

As for student loans, once they are at collections your hands are ultimately tied and you need to contact collections. If they are simply being unbearable you may want to contact a credit counseling agency in your area or perhaps your original trustee to see if they have any suggestions.
