What about new debt?

If I just recieved a new credit card (1 week), and it is already at it’s limit can I still claim bankruptcy? Is there some sort of law in place to stop people from racking up credit cards and going bankrupt the next day? Thanks in advance!

In every bankruptcy all creditors review your transactions with them in the three months prior to bankruptcy, and if they suspect that you borrowed from them during that period before bankruptcy, and knew that you couldn’t pay it back, they can pursue you after you are discharged from bankruptcy.

The best thing if this is a concern is to do discuss this in advance with a licensed trustee and together you may be able to develop a strategy that will allow proceed in the best of all possible directions.
