Revenue Canada and Consumer Proposal

Hi,

I filed a 5 year Consumer Proposal in 2004. I had my tax return done and I am entitled to a refund this year. Revenue Canada was listed as a creditor because I owed money in the year I filed my Proposal and I was told by my Trustee to include it in the Proposal. Will Revenue Canada be able to keep my refund this year???

If you filed in 2004 I don’t see any reason CCRA (formerly Rev. Canada) would be able to retain funds from 2005. If they do I imagine it would simply be failure to accurately recorded the proposal on CRA’s system and suggest you contact them directly to ask why the funds were kept.

…I also filed a proposal in 2004 with CRA as a creditor…when I filed my refund for that year (i.e. in Spring 2005), CRA took what was owed to them and I received the rest. It’s my guess that until your debt to them is paid, they will continue to seize your refund.
