car lease and unemployed

I am married and I have about $10,000 in unsecured debt in my name. My husband has a leased van in his name for work? Can they do anything with the van, if I claim bankruptcy?
The reason I am considering bankruptcy is because my one child has some special needs that has caused me not to be able to work. So if I have no income (adn my hubby has very little for our family size) how does that affect me and anything I owe?

As long as you have not personally signed anything related to vehicle there shouldn’t be any impact on the leased van should you claim bankruptcy.

Depending on the size of your family and the income coming into the household the presence of a child with special needs may serve to reduce the cost of a bankruptcy. When you meet with a trustee he will explain that the cost of a bankruptcy can vary based on a guidelines issued by the Superintendent of Bankruptcy and sent to every trustee in Canada. Essentially this calculation provides an allowance for these specialized types of expenses.
