Bad Advice

The large company I chose when I filed for bankruptcy June 2005, made a few errors. One of the errors was when they told me that a title loan I had on my vehichle ( with only $240 left to pay ) was going to be included in the bankruptcy. They notified the company, & I was told not to worry about it. One month later the company repossessed my vehichle in the middle of the night!! I later found out that the person at the banruptcy office who had filled out all the paper work may an error. It cost me over $700.00 to get my van back & I lost a days wages at work. When I called the bankruptcy office and wanted them to explain how this could happen they said a trustee would call me that week. NO-one called, they kept passing the buck & I really could not get an answer to the problem. Obviously, as a single mom with $15,000 credit card debt left to me by my ex-husband, I had very little money even working full-time. I had to borrow the money to get my van back from a friend. I believe that some-one messed up pretty bad. After all I had no idea about the process & what could or could not be included as a debt, I had never done this before! I trusted them to know what to do! Who is responsible for this loss of money to me? I am still trying to pay back my friend! I thought filing for bankruptcy would help me with a fresh start & I ended up with a debt I should never have had to pay. Is there anything I can do about this?

If you are not able to resolve your dispute with the firm that assisted you then you have a couple of options:

1) Contact the nearest Office of the Superintendent of Bankruptcy and lodge a complaint against the firm. Your trustee shoudl be able to provide you with a direct number to call for your area.

2) Consult with a lawyer.

Mistakes do happen and in most cases, the firm you are dealing with will take the steps necesary to correct the problem. That being said, you obviously are dissatisfied with the service that you have been receiving and therefore may need to pursue one of the options set out above.
