We are 9 months into our second bankruptcy and I am a little perplexed that our trustee doesnt want monthly income statements or tracking statements of our expenses. When we filed she said it wasnt required, but now I am thinking after reading some posts she might be wrong. I really dont want to have this delayed because of bad advice from a trustee. I might also mention that we asked her about this and about two creditors she didnt have listed. She told us that those creditors didnt or couldnt find our files when she contacted them and that it was tough luck and they would get nothing. Now if they ever find those files can they still come after us, and are we required to fill out monthly income and expense statements?

I appreciate your concern, but you need to have this conversation with the trustee that you are currently dealing with. If she has told you that something is (or isn’t required) then that’s her decision. Without knowing more about your situation I am in no position to second guess her.

If you are convinced there may be a problem then I suggest you contact the nearest Office of the Superintendent of Bankruptcy and discuss your concerns with them.
