How do I Force a Bankruptcy?

As a creditor, how do i begin the proceedings against a debtor?

And even though the debtor tells me he has no assests or savings, should I still proceed to have a trustee validate this?

In order to petition (force) a person or business into bankruptcy you must consult with a lawyer that specializes in insolvency work. Since it sounds like you are dealing with an individual that owes you money I suspect the lawyer will advise against forcing them into bankruptcy. There are better (and by that I mean more effective and less expensive) ways to collect the money you are owed.
