2nd time bankruptcy
About 19 or 20 years ago, I was forced into bankruptcy when my ex-husband went bankrupt and I had co-signed everything. I have had excellent credit for the last 15 years and have not missed any payments, but unfortunately now due to my health as well as not keeping on top of things, my new husband and I are living on our credit cards and we either can pay the credit cards or living expenses. My question is; as my husband has never been bankrupt before, I do not want him to be penalized because this would be my 2nd one, can I file separately or is this even advisable. I am concerned if I die (from the cancer I have), I don’t want him to be longer than needed before he is discharged.

You can definitely file separately, although it may be slightly more costly. I would suggest you review these concerns with your trustee prior to signing anything so they can review all of the pros and cons with you in advance.
