Student Loans

I am 2 payments away from finishing a Consumer Proposal. Included were my student loans. My question is: My last loans were for the 1995-1996 school year. I was a student from 1996-98 but had no loans. If the law right now says that they are discharged after 10 years, will they be discharged with my proposal, or will I still owe the interest on them? I am getting no help from my trustee on this matter, she doesn’t seem to have a clue about student loan laws. Thank you so much, hope you can help me.

Student loans are excluded from bankruptcy proceedings (and proposals) until the student has been out of school for at least 10 years. If y9ou wife is currently a student then her existing student loans would be excluded from bankruptcy.

If she has not defaulted on any payment terms on her existing student loans, and she meets eligibility requirements for new loans, she should still qualify for new loans even if she has filed for bankruptcy.

The best thing for her to do is speak to a financial aid officer at the school she is attending to find out what the specific rules are in her case.
