There is nothing preventing the ex-spouse from claiming bankruptcy. As for how it would effect the outcome of the division of property, this really depends on how this division took place. Typically the division of property within the court order stands and the bankruptcy ules are applied to the remaining possessions of the individual filing the bankruptcy. However, the specifics are important and should be reviewed personally with a licensed trustee as they may have a significant impact on the way the bankruptcy will transpire.
