Must be employed to claim bankruptcy?
I took your websites advise and met with a trustee. After 2 hrs, she sent me to home to contact all my creditors to seek a months grace and basically told me to contact her or her office when I became employed again. Do you have to be employed to claim? I am on MB EI and only make enough to cover the mortgage. Is she just worried about her fees? This seems like one of the most appropriate times to claim bankruptcy. I’m confused. Should I seek out another firm?

You don’t have to be employed, but while you are not employed there are 2 issues:
1. A bankruptcy may not be immediately necessary as there may not be any assets that your creditors would be able to pursue; and
2. The licensed trustee potentially could be concerned with the payment of fees.
I would contact the trustee’s office and as what their reasoning was for holding off, and if it was simply an issue see if there is a way that you can make a small payment each month and extend the bankruptcy over a longer period of time.
