bank account and collection agency

hi yesterday i went to get my paycheck out of my bank account and it was all gone at first they told me at the bank that it was to cover my overdraft but then they said no that it was a collection agentcy that took the money out for a debt that they said i owed. Without a court order does anybody have the right to go into my bank account and take my whole paycheck i now have no money for food or bills i live in nova scotia canada.

I suggest you go into the bank in person and ask for an explanation. Collection agencies have no greater rights that anyone else when it comes to your bank account. In order to withdraw money from your account they require:

1) authorization from you – for example a cheque (did you bounce a cheque to them recently? If you did, they may have simply tried to cash it again right at your branch)

or

2) a Court Order allowing them access to your account.

In either case, the bank should be able to show you how/why the money was withdrawn.

If the money should not have been withdrawn, I’m sure the bank will make things right – if not, it is time to go see a lawyer.
