Where to declare

My fiance will be leaving his Ontario job to join me in Saskatchewan after we marry. He is a slave to his loans (about 45K, of which 10K is OSAP), still living with his parents nine years after graduating university to afford to service them. He has no assets, and bankruptcy is looking pretty good. Should he declare in Ontario before getting into real hardship, or wait until he gets to Saskatchewan? I may only be here for a few months after he arrives, and don’t know in which province (or country) I may wind up next. A side issue; will our imminent wedding be considered unusual spending on his part? We are keeping it modest, but even so, his portion or the bill is amounting to about $6000. How will refundable portions of deposits he paid be treated if he declares before we marry?

If he has no assets, and you have not clear idea of where you can expect to be living over the next year than there is no reason to delay filing a bankruptcy. Tell him to contact a licensed trustee and begin the process (the sooner it is begun, the sooner it will be finished).
