what is the next step
My husband and I separted last year (august).I have been paying the morgage, and living in the family home with my children. In May my ex husband filed bankruptcy. He now pays 320.00 a month (he tells me) so that bankruptcy wont take the house. I recently went to court. Where I was granted child support , sole occupancy of the home and a divorce. The house could not be settled because it was with bankruptcy. I dont know what the next step is in getting my home solely under my name. Can i do that with land titles. I am really so confused. Can you answer these questions?

You must speak to your lawyer to have the house transferred into your name. I assume that the house was owned jointly. Your husband may have paid money into his bankruptcy estate to prevent the trustee from taking his half interest in the house. If that is the case, your lawyer will need to contact your husband’s trustee to get approval to transfer the house solely into your name. Without knowing the value of your house, I do not know if there is any equity in the house (equity is the difference between the value of the house and the amount owing on the mortgage).
