my husband is about to declare bankruptcy in canada..we live in the states…..however our credit card of which we only have one….is a US card…we have all our money in the bank here in the us…..will the us bank take whats in our account and put it toward what we owe on the card….could I close the account and open another one and deposit the money in my own account…I really need some help here

Canadian law requires your trustee to list all of your debts, including your US credit card, so it is possible the issuing bank may take some action against your accounts. We generally advise people to change their bank accounts BEFORE they file to ensure that there won’t be any “problems” like the one you envision.

In case your trustee hasn’t told you so already, Canadian law requires you to surrender all of your credit cards, including your US cards, when you file. If you owe any money on the US card it is an offence under Canadian law to pay it off while you are under bankruptcy protection.

You might want to discuss all of this again with your trustee before you sign any papers…
