Surplus Payments
I have recently filed bankruptcy for the 2nd time (the first in 2001 after a very nasty divorce and the second a few months ago due to a gambling problem I am now getting help with). My surplus payment is $344.50 every month for 18 months. I have asked my trustee if I can extend this payment to 36 months or even 24 months to bring the payment down as I’m finding it very difficult to make the full payment. The trustee said 18 months is the max but someone in his office said that is not the case. Can you help?

It is the Trustee’s opinion that matters, not anyone else in the office. There could easily be something in your file that prevents further extension that the more junior employee simply doesn’t understand or is not aware of. If you are confused by this, sit down with your trustee and simply ask what is preventing the extension of these payments to the longer term.
