Situation with my student loan and bankruptcy
Hello,
It has been 10 years since I have been out of school. May or June 1996 at the very latest is when I would have finished. And it is now Oct. 2006.
I filed for bankruptcy in May of 2004, when it had not yet been 10 years since I was out of school, so I was not able to include my student loan at that time.
As of today, it has been more than 10 years since I have been in school. Can I apply to have my student loan included?
My income has not increased. My hourly wage has increased by $0.39/hour, but I won’t have as many hours this year, so my income has been less, and I’ve not yet been able to start making payments on my student loan. Would they hold that against me? I’m just wondering what I should do with regards to it. It’s approximately $5,000 that I will owe on it.
Thanks

There is a “hardship†clause that permits just this type of application. The best thing for you to do would contact your trustee, explain your circumstances just as above and have him explain in detail how this is done and what needs to be done to do so.
