My Ex owes money to the trustee, why is MY discharge being held up?
When my house was sold, my EX whose name was on the mortgage, got %50 of the proceeds of the house. There was about $4000 that I had told the trustee I had paid to her the year before. It was money I gave her so she could move out and start over; approximately $1000 a month for 4 months.
This money was supposed to be held back, not paid to her, and rolled into my bankruptcy dispursements. The Trustee made an error, and gave her all the money.
Now the trustee will not discharge my bankruptcy, because she won’t pay it back.
I’ve fulfilled every duty required of me to qualify for the discharge.
Can they really hold me back because of this?

If the trustee really made an error then you may contact the Office of the Superintendent of Bankruptcy and ask them to investigate why your disharge is being withheld. That doesn’t mean they will agree with you, but at least they will ask your trustee a few questions and that may start the ball rolling again.
