I am in a same sex spousal relationship, and because of heavy debts, am considering bankruptcy. The house we live in has always been in her name, as she is the one who has paid for it. It is the same with most of the household things. How will claiming bankruptcy affect her? Can a trustee insist upon the liquidation of household things she has purchased to pay my creditors? Will this affect her credit rating? What about her financial assests? How protected is she? Do I need to consider leaving the family home in order to protect her?
I am self employed, full time, and have also taken on casual work in an attempt to make headway.
I have virtually no assests of my own, as any assets have long since been cashed in to cover outstanding debts. My partner has never had any financial trouble, and is planning to retire soon.
Any suggestions??

I think you should start by contacting a trustee in your area so that you and your spouse can make arrangements to go and meet with them. Things that belong to your spouse will not be subject to seizure or sale – that includes the house, furniture, etc. You simply have to prove to your trustee that these things have always belonged to your spouse.
