RESP contributed by spouse
April 3rd, 2009 by Questions
My wife registered our kids for resp`s in 2004, she is the sole person on the forms and the sole beneficiary and she made all of the payments to the funds. If I claim bankruptcy what will happen, will i need to disclose these?

You are best to discuss this with a local trustee. As long as you can demonstrate all the money relates to your spouse, then you likely won’t loose these funds, but you need to discuss it with the trustee otherwise the banks may in-inadvertently send these to the trustee.
