Foster Parenting

I am considering bankruptcy due to a loss of income. I also am a foster parent. My question is does the per diem amount count in the surplus income calculation if I don’t count them as people living in my home and use them to increase the threshold number. It is non-taxed, and it goes to the child. Should I be adding them as both?

You don’t have the option of deciding who is or isn’t in your household – a minor living in your home is going to be considered part of your household and any income associated with the minor will be included in the total household income for the surplus income calculation.
