Bankruptcy and child support

Hi, my question is regarding bankruptcy. I am currently getting spousal support in the amount of $1350 and Child support payments of $2650.00 a month. Combined it is $4000 a month. If I was to claim bankruptcy would I loose a lot of money because of the surplus income formula? The child support is for one child.

You might – the surplus limit for a 2 person household is $2497. If you have $4,000 a month coming in without any deductions your bankruptcy payment may be $752 a month for 21 months. Of course allowable deduction might reduce that amount.

My best advice is to contact a trustee in your area to discuss your situation – they will be able to give you a precise answer of what your surplus income payment will be.
