child support arrears
July 27th, 2011 by Questions
Hi,
My ex is 40,000.00 in arrears for child support and there is currently a federal garnishment in place so that we receive his income tax refunds…gst etc….if he were to go bankrupt…would these then go to the creditors…or would they continue to come to us? Wondering if the banktuptcy cancels out fro until the discharge?

Support arrears are not eliminated by filing bankurptcy or a consumer proposal. Support payments survive the process and FRO is not restricted from garnisheeing wages and/or tax refunds during the process either.
