garnishments
May 27th, 2009 by Questions
I have been in a bad divorce and have still not received a cent in support from my ex..I am barely getting by as it is with 2 small children. I already have one garnishment coming out of my pay and have just been served with another one. If I file for bankruptcy, do these stop immediatly or is there a time frame..I cant take much more!!!!!
Thank you for your help 🙁

The filing of a bankruptcy there is an immediate Stay of Proceedings that comes into effect. This is legal court protection that removes your creditors rights of collection. As such it will immediately remove a garnishee.
My suggestion is you need to contact a local trustee right away so that you can try to begin the process prior to your next pay period.
