Can Employment insurance repayment amount be claimed in a bankruptcy?

Yes they can, but if you file a new claim in the future it is likely that your EI benefits will be clawed back by 20% to recover the past overpayment. It is not lin my opinion legal for them to do so, but EI will likely do it anyway…
