secondary card holder
February 27th, 2008 by Questions
I`m afraid that I will have to declare bankruptcy in next couple of months. If I`m currently a secondary card holder of my brother`s credit card, when I file bankruptcy, does my brother get affected? Thanks

A couple of things will happen…
First, you must surrender the credit card to your trustee when you file; and
Second, if there is a balance payable on the card when you file it must be included on your list of creditors.
I suggest you contact your brother and ask him to have your name removed from the account (and therefore have your card cancelled). It means he is assuming full responsibility for any balance on the card, but he is responsible already as the primary cardholder. If the card is cancelled before you file then it should not affect your brother in anyway.
